of a fatal accident this morning. before 10:00 a.m. a male driver in a toyota and his passenger ended up trapped in their suv upside in water. >> the vehicle drifted off the shoulder to the right. crossed through the right shoulder area and down into a drainage. >> we were trying to help them out. >> i got a bar here, i handed it over to those guys trying to open the door. >> reporter: but they couldn't get to the victims in time. they were pronounced dead at the scene. people are familiar with the hazards. >> should be widened or a k bar. >> reporter: dangerous because of the narrow shoulders and speedy drivers anxious to pass the many trucks on the road. >> people come near me when they are passing. >> reporter: the chp is investigating the cause of the

crash. they don't know why the driver veered off the road but speed was not a factor. allie rasmus, ktvu channel 2 news. police arrested three men last night in oakland after a high-speed chase and think the suspects might be linked to crimes in hayward and san jose. it ended after the car they were in spun out. it started in hayward when officers tried to pull the driver or for driving under the for the fluence. police -- influence. police think they were involved in a shooting. >> there was a incident that involved a shooting from a vehicle. we are determining whether or not this vehicle was involved in that. >> police are also investigating whether the three men were involved in a armed robbery and shooting in san san jose. the castro district will be the scene of a rally and march in support of same-sex marriage. ktvu's noelle walker is live

where the supreme court court, all eyes on the supreme court. >> reporter: we have seen a few people here with signs and flags. they are starting to set up for a huge rally and march to city hall. supreme court is taking up the debate tomorrow and this is not a black and white issue. there are a number of ways the court can go. >> reporter: 20,000 same-sex couples in california said i do. and then in november california voters said we don't. proposition 8's ban on same-sex marriage set up tomorrow's supreme court show down. >> we will get guidance from the highest court. >> reporter: she says there is a rainbow of options the court can decide. the justices could uphold the ban which would leave the issue up to individual states to

decide. the court could invalidate all bans on same-sex marriage. it is unlikely. it is what the supreme court did in 1967 when it struck down virginia's ban on interracial marriage and extended it to every state. >> it is likely the supreme court will not uphold all the bans or strike all the bans down but do something in the middle. >> reporter: that could strike down prop 8 that only in california did same-sex couple have marriage rights and have them taken away. it could be a 9 state solution. right now the highlighted states allow some form of civil union. for those states the court will have to answer a basic question. >> are you trying to signal that same-sex couples could be in a second class status? >> reporter: whatever the decision, the supreme court is

likely to leave room for future debate. >> reporter: now legal experts aren't expecting the court to make the decision till the end of june. in the mean time, coming up at 6:00 p.m. we will talk to some of the people who are helping organize tonight's event. back to you. there appears to be support among americans for same-sex marriage. 57% of people say they have a family member or friend who is gay. that is up 12% from 2007. another pole shows support for same-sex marriage rose from 40% to 53%. the news comes a day before the supreme court is due to hear the arguments about california's ban on same-sex marriage. ktvu's david stevenson is on his way to washington, d.c. right now, he will have live reports and stay with us for a

>> police say evan ebel a man polled is a suspect. -- paroled is a suspect. he was killed in texas. investigators confirm the bullets that killed him came from the gun found with evan ebel. after the shoot out. the sheriff's department in texas was trying to determine what his motive was. he was a former gang member. >> one of two teens accused of a shooting death was in court today. a judge said he would be charged with murder. he did not enter a plea and the judge didn't say whether he would be charged as a juvenile or adult. he approached her and demanded money and one of the teens shot and killed the baby. the other suspect will be

charged as an adult. jerry sandusky has given his first interview since going to children. jerry sandusky talked with a documentary maker who is making a film aimed at jeering joe paterno's name. he asked jerry sandusky if he shot joe paterno would have kept him on if joe paterno thought he was a danger to boys. >> i would say no. if he had a suspicion, i don't know the answer to that. >> joe paterno's statement called jerry sandusky's interview self serving and another insult to the victims and anyone who cares about the truth. jerry sandusky's sentence requires he serve 30 years in prison. construction continues on the massive hospital campus project in palo alto. ktvu channel 2 news cameras were there last year when they

stole the car as the baby was sitting inside. the girl is little gabriela quintero. she looked healthy and calm as officers found her. she was taken to the hospital and deemed completely healthy. her mother took her home 90 minutes ago and earlier ktvu's robert handa brought us a live report from san jose. robsert staying in contact -- robsert staying in contact with police -- robert is staying in contact with police and will have more at 6:00 p.m. a victim was found last night before midnight. he was airlifted to the hospital and underwent surgery. so far no arrests have been made and police haven't released information about a suspect. the contra costa county coroner identified a man whose body was found in the bay on sunday. police don't know how the body of richard wood ended up
